It's Good Times for the Rich: Luxury Spending Surging Worldwide

It?s Good Times for the RichConsumer spending on luxury goods continues to ramp up.

The easy monetary policy by the Federal Reserve has created a whole new generation of millionaires, or the ?new rich,? as the stock market propels to new records.

The spending on high-end goods in the retail sector was further confirmed on Tuesday after high-end jeweler Tiffany & Co. (NYSE/TIF) delivered an impressive quarter, driven by a rise in global spending. The fact that spending on luxury goods is on the rise globally is bullish.

Recall my recent Profit Confidential article in which I stated that the rich continue to spend (see ?Higher Taxes: Who Cares? Not the Rich?). The Shullman Luxury and Affluence Monthly Pulse, which is an excellent metric detailing the spending habits of consumers making over $250,000 annually, suggested that higher taxes will not impact the spending patterns of 61% of those earning over $500,000 annually. It appears Tiffany is proving the research correct.

In the first quarter, Tiffany reported a nine-percent rise in its worldwide sales to $895 million. If you looked at the sales numbers on a constant-exchange-rate basis, the increase was 13%. Interestingly, the sales increase was worldwide, which bodes well for Tiffany.

In the main Americas region, sales increased six percent to $408 million, representing 46% of total sales. I feel this allocation will shift, as Tiffany expands its presence in Asia, which currently accounts for about 41% of total sales.

The Asia-Pacific region including China but excluding Japan reported impressive sales growth of 15% year-over-year to $223 million. Tiffany?s key comparable store sales jumped nine percent.

The results from Japan were affected by the weak yen, which made the currency translation impact quite noticeable. Yet sales still managed to rise two percent to $145 million. On a constant-exchange basis, sales in Japan surged 20%, with comparable store sales up a whopping 21%. See what the easy monetary policy in Japan is doing?

Even the economically challenged eurozone region managed to pull off a six-percent increase in sales to $93.0 million, which is good, given the mess in this region.

With the report, Tiffany?s shares surged to a new 52-week high on Tuesday and have outperformed the S&P 500 over the past 52 weeks.

While Tiffany reported excellent results, my favorite luxury-brand stock continues to be apparel and accessories-maker Michael Kors Holdings Limited (NYSE/KORS).

Zalora MD on building a billion dollar business in ... - The Next Web

Southeast Asia witnessed one of its most significant funding deals to date last week, as Zalora, a fashion-focused e-commerce service backed by notorious German incubator Rocket Internet, landed a $100 million round of investment.

Though huge, the deal got a muted response from many technology watchers in the region since it follows a slew of other multi-million dollar investments in Zalora and Lazada, its sister site and fellow Rocket Internet company focused on technology.

Yet, despite the scepticism, Zalora has raised upwards of $150 million so far (some rounds were undisclosed) which is quite a feat for a company that is barely one year old, let alone one in Southeast Asia?s nascent online retail industry. The scale of investment being pumped into Zalora (and Lazada) makes them ? in appearance, at least ? very different companies from the kind that Rocket Internet found notoriety with.

That is to say that, rather than cheaply-made clones of successful companies built with acquisition and exit in mind ? for example, Rocket Internet?sold CityDeal to Groupon for $126 million ? the firm and its partners are investing hundreds of millions to make a nascent industry mainstream in a market where most of the world?s biggest e-commerce firms are not present.

Aloha Zalora

Launched in March 2012, Zalora is a Rocket Internet-backed company that runs an online platform selling a range of fashion items such as dresses, shows, bags, shirts and more to shoppers across eight markets in Southeast Asia and beyond: Malaysia, Singapore, Indonesia, Thailand, Philippines, Vietnam, Taiwan and Hong Kong.

The company is aimed at filling a gap in the market. While the region?s 500 million plus consumers are as focused on fashion and trends as the US, Europe or any other part of the world, there?s no ASOS, Zappos or other online fashion retailer that is catering for their needs across the region.

Internet usage varies from market to market by, with smartphone owners growing on a meteoric scale, increasingly fashion conscious consumers are going online ? often via mobile ? but with no recognized retail platform stepping up to serve them. That opportunity ? -which grows as affluence and Internet usage continues to increase ? is the spot that Zalora is targeting.

Billion dollar dreams

?The goal is to build a multi-billion dollar firm, the biggest e-commerce company in the region,? Zalora Managing Director Michele Ferrario?tells TNW in an interview. ?We?re investing heavily to create the best place for consumers to shop online in Southeast Asia.?

The latest $100 million round included investment from a range of regular Rocket Internet financial partners ? Summit Partners, Kinnevik and Tengelmann Group, along with Verlinvest ? each of which, Ferrarrio says, brings experience to the table. Zalora?s backers include both consumer-focused retailers and those that have found success online. Their feedback and interaction are critical to success, he adds.

Rejecting opinion that Zalora is ?just another Rocket clone?, Ferrario?argues that the business aims to be sustainable and long-term.

?We are not looking to sell fast or anything like that. This [type of business] is not new for Rocket Internet, Zalando?[an online retail service in Europe] is similar but around four years further ahead of Zalora. Rocket Internet is still very involved [in Zalando], as the strategy has not been to sell, rather to build a new large, profitable business.?

Likewise, for those that accuse the company of copying Amazon, Rakuten or other successful business, Ferrario?points out that 99 percent of business success is about execution, adding:

?Selling fashion online isn?t copying. If you open a coffee shop, you?re not copying someone else, like Starbucks. We?re just selling fashion online and I don?t see that as copycatting,? he argues.

Focusing on service

Zalora recently delivered its one millionth order and, while?Ferrario does not disclose any details about company revenue ? despite TNW?s keen interest in the topic ? he does say that the company has delivered to customers in more than 16,000 cities in Southeast Asia (yes, sixteen thousand), emphasising that service is very much the focus.

?Our three biggest priorities are value for money, selection [of product] and service,??Ferrario explains. While those three elements are staples of any business involved in retail and service, Zalora has come up against problems in Southeast Asia, notably the immaturity of delivery networks and lack of established infrastructure.

?We?re ?investing in our regional footprint, to provide a last mile fleet [for delivery] in most capital cities across Southeast Asia. We can do next day or one-day delivery in major cities, and delivery in one or two days in others,? he says, explaining that the goal is one-day delivery to any place in the region.

Those issues may have prevented big companies from launching in Southeast Asia (although Amazon recently began delivering electronics to the region) in the past, but Ferrario ?expects? that to change sooner or later.

?We already know that millions of people in Southeast Asia are online, the Internet population here is already very large now and it will continue to grow fast.?Nobody has really offered a professional retail service in this region, some infrastructure is here but nobody is offering the service to match.?

Some may feel that a lack of widespread Internet access in many countries means that Southeast Asia is still some way from being online, but Ferrario points to the travel industry for proof of potential in the region.

?Online travel is fairly well developed, for example,? he says. ?People book flights and buy tickets in large numbers already, airlines went online first and people began picking it up. We?re making sure people are finding fashion retail online.?

Given the lack of competitors, it?s fair to assume that Zalora is, in effect, building an industry and demand for its services, as well as its own business. Ferraro, however disagrees.

?I think we are building awareness of fashion retail online, since e-commerce is already here and successful,? he says.

Zoning in on the difficulties of doing business in Southeast Asia, a region where cultural, politics, language and many other market patterns vary significantly from country to country, he adds:

?Southeast Asia is a complicated market to be in, you really need to invest time and effort in several things. If you want to provide a good service, you need to be there. [Operations] requires investment and capacity to be there, and that?s a big roadblock. Likewise, offering content from brands isn?t easy since distribution rights are fragmented.?

Working with ?thought partner? Zalora

Zalora and its electronics-led sister site Lazada are very often thought of in tandem. In addition to sharing common investors, both companies are aiming to grow in Southeast Asia and create an environment for e-commerce, so how do they co-exist?

?We are separate companies. We talk regularly and often have offices that are together so you could say we are thought partners,? Ferrario explains. ?We are creating an e-commerce market together, towards the same goal, so we look at each other and find ways to think about a market in separate way.?

Given the supply chain challenge, the two companies do share warehouses in some locations, but the operations and areas are clearly separated for each company, according to Ferrario.

Staffing churn and the revolving door

Early in its time in Southeast Asia, both Lazada and Zalora got a reputation for a high amount of turnover from staff.

That worked in two ways. Firstly, it was said that in many in places ? such as Bangkok and Singapore ? new joiners from Asia struggled to adapt to the company?s mentality and the demands of working life. That was said to include late nights in the office, a gruelling schedule and other in-office demands that are common with a company that is starting out.

That led to many leaving the company within months, or weeks, of joining, and both companies become known for operating a ?revolving door? of employees in some Southeast Asia cities.

At the same time, many of the European managers brought in to oversee operators came and went. Past defectors told TNW that this was in part due to cultural and adaptation issues, and in other cases due to the constant turnover of junior staff and other business-related issues.

A year on and Ferrario doesn?t believe that the turnover has been notably high. Either way, he says, Zalora has found its core team and that it is a place for those that want the kind of challenge that an ambitious, growing business offers.

?We have a very stable team, but, obviously, with more than 1,000 people some kind of churn is natural. Someone else launching a similar biz would struggle to attract the quality staff we have,? he suggests.

?It?s a very, very hard job to build a company at this scale and speed; it isn?t for everyone. There were people who joined and left [in the early times] and that?s part of trying something that?s very hard. Now we have very stable team in place.?

Rocket Internet companies in Southeast Asia have helped birth a number of new firms across Southeast Asia, with execs and junior staff alike leaving to start new businesses, such as HotelQuickly, after a taste of startup life.?Ferrario takes this as a compliment and believes it is emblematic of the ethos of the company

?If you teach entrepreneurism some people will want to do things on your own, it?s natural, much like McKinsey sees many employees leaving for managerial jobs,? he says.

Profitability by 2015

Ferrario insists that ?there is no plan? to reveal revenue and other financial figures just yet, but he does tease that revenue is already in the double-digit million (US dollars) range across the region. Pushing further, he expects the company to be profitable before 2015.

?We are a young company investing heavily to be leader in the market, and the aim is to be profitable by 2015,? he says.

Reflecting on the company?s mission, Ferrario adds that ?this is a very hard job. When people ask me what keeps me awake at night, I say it?s that we need to be perfect everyday, there?s no Sunday. We need to pack all orders, deliver super fast and be super structured every single day.?

While service is obviously a key area, so too developing for mobile is an important focus for Zalora. The company launched mobile versions of its websites in the beginning of the year and its iOS app, launched one month ago, has performed ?above expectation?, according to Ferrario.

Right now mobile accounts for around one-quarter of all sales, but he foresees that changing in the coming period.??We expect that within 18 months or two years, we will see more sales via tablet than desktop and PC,? he predicts.

Explaining that tablets are the particular focus of mobile because the larger screens are better suited to shopping and Internet browsing than a smartphone, Ferrario?adds that the devices ?are more present in customers? lives?. They are particularly important, he argues, because many consumers in Southeast Asia leapfrog the desktop PC experience, going straight to mobile.

A new approach in emerging markets

Rocket Internet and its businesses, like Zalora, aren?t about to undo their reputation as copycats, but, in the case of Southeast Asia, there?s a strong case to be made that they are genuinely pushing the barriers and providing a service that is unique to the region. It?s barely fair to call the company a startup ? its revenue from investment is on another planet ? but, as we?ve said before, it is inspiring some would-be founders to believe that they can make a company in Southeast Asia, helping young people get a taste of entrepreneurism and educating the wider market about e-commerce; all of which is most definitely?a good thing, irrespective of whether you believe Rocket Internet is little more than a clone factory.

Whether or not Zalora or Lazada will stifle small e-commerce players, or be rivalled by another large company in Southeast Asia is unclear at this early stage. Going on feedback from friends and family, the service is still lacking the quality and consistency of major fashion firms like ASOS, while there still appears to be a steady stream of staff leaving despite comments to the contrary. With Ferrario?up all night worrying ?about service and Rocket Internet investors continuing to pour money into the company, both companies are the online commerce players to watch in Southeast Asia despite those concerns.

Raising Children in the Digital Age: An Interview with Lynn Scofield ...

Your book is full of evocative phrases and concepts. One of my favorite is that of ?emotional downsizing.? When and where does ?emotional downsizing? occur and what does it tell us about the context in which contemporary parenting occurs?

I used the term ?emotional downsizing? to talk about parental expectations regarding family life and how media fit into these expectations. This comes up in a specific example about a mother who talks about how she wishes that her family could do more activities together, but they don?t due to the time pressures they face (the parents have demanding jobs and the teen and preteen children have school, activities, and for the younger child, time in child care rather than at home). The mother wished that they could engage in different kinds of activities together ? like hiking or playing board games together ? that would require them to be ?unplugged.? Yet sometimes, the pressures of everyday life meant that she needed to lower her expectations about what was realistic and possible. This is how ?movie night,? while not a preferred activity for this mom (and for many of the parents I interviewed), became nevertheless a positive instance of ?family time.? Doing something together, even if it?s a less parentally approved activity, is still worthwhile and sometimes it?s the best we can do in what can be an exhausting schedule of family life. Parents therefore lower their expectations of an ?ideal? family activity, or engage in emotional downsizing, coming to see the up side of engaging in mediated activities together.

Incidentally I discovered after writing my book that I use this term in a way that differs from sociologist Arlie Hochschild?s use of it, although I refer to her work on family life throughout my book (e.g., I use her term ?emotion work? to talk about what parents go through when justifying the decisions they make in relation to emotions rather than rational decision-making). In her book The Time Bind, Hochschild uses the phrase ?emotional downsizing? to refer to what happens when parents assume that their children need them less than they do, which is followed by ?emotional outsourcing,? or leaving children in the supervision of hired caregivers. I observed both of these, but I wanted to highlight how television, movies, YouTube sharing and other mediated leisure activities ? often discussed as less desirable than other activities ? come to be part of something that family members view positively as ?family time.?

At a time when many of us are writing about the values of ?connected learning,? your book offers a ?reality check.? What kinds of obstacles or challenges do you see in trying to create richer educational opportunities for youth through the informal learning sector or for connecting what takes place in the home with school-based learning?

That is a great question. U.S. families across the economic spectrum are so busy these days, whether that?s due to work and activities in the best of situations, or due to the chronic health issues, doctor?s visits, and inconvenient transportation and work schedules that tend to be part of the most challenging family experiences. I love the ideas involved in connected learning: the interest-powered, peer-supported, and academically oriented learning principles and the production-centered, openly networked, and shared purpose design principles. But I do see two key issues.

First, both parents and young people need to see how connected learning is in the interests of the young people themselves. This is obviously the point of developing case studies that demonstrate the effectiveness of learning in places like Quest2Learn and the Digital Youth Network. These will demonstrate that connected learning helps young people develop skills and literacies they will need to survive in education and beyond.

But secondly, both parents and young people need to see how connected learning is consistent with their goals as a family. How can programs of connected learning give parents opportunities to share their values and life experiences with their children? How can programs of connected learning help young people to feel that their experiences and perspectives are valued by their parents? Of course, connected learning isn?t a ?program? so much as an approach, but parents may need to see specific programs in order to recognize how it is that their child?s school wants them to engage and will value their life experiences and familial goals in the process. I think that embracing a family-centric approach will move ?connected learning? out of the headspace of ?homework? or ?youth after school activities? and into the space that I think the connected learning innovators want to go, which involves strengthening bridges between home and school life.

While the book is primarily descriptive of a range of different models of parenting in the digital age, you end with some normative advice about the ways parents might improve upon the quality of experiences they have with digital and mobile technologies. What philosophical commitments govern this advice for you?

I wanted to avoid giving very specific advice about hours spent in front of screens or with mobile devices. Instead, going back to your first question, I wanted parents to be able to think about the ?parent app? that best fit their own situation and needs. For me, I think my primary philosophical commitments are to the inherent worth and dignity of every person and to the interconnectedness of all people and living beings of nature. I believe that we each need relationships of trust, mutuality, and compassion to survive, and we each have responsibilities to act in ways that foster those relationships. Maybe this is especially so in our primary relationships with our families. So I wanted to end the book with some suggestions rooted in the idea that all of us share a desire for meaningful relationships of mutuality and respect. I have a longer list in the conclusion, so here?s the edited version:

1. Be clear and fair about expectations regarding digital and mobile media, but be willing to change as children grow older and their needs change
2. Model the behavior you want, which includes prioritizing time together
3. Let children take the lead in teaching you about their media lives

But I also didn?t want to lose sight of the fact that for a lot of people, our experiences are related to and limited by not just what we can choose to do, but our cultural and social environment. So, I wanted to propose that collectively parents can work with others to shape an environment that better meets our desires for trust, mutuality, and compassion.

Thus, in relation to the bigger picture:
1. Change the situation for young people
2. Change the media to change the culture

As I write at the end of the book, the digital and mobile media that are so much a part of our lives may seem inevitable, but the particular forms they take and the organizational patterns governing the industries that make and distribute them are not. It is up to us to choose how these media will fit into our collective lives and how they will shape the lives of our children and families in the future.

Adam Bernstein to direct FX's 'Fargo' premiere

NEW YORK (TheWrap.com) - Emmy Award-winning director Adam Bernstein has signed on to direct the premiere hour of FX's first limited series, "Fargo."

The "Breaking Bad" and "Rescue Me" veteran won his Emmy for "30 Rock." He also directed the premiere of "Alpha House," one of five new shows ordered by Amazon on Wednesday.

"Fargo," a 10-episode series inspired by the 1996 Coen brothers film of the same name, will feature a new crime story but retain the original's humor and darkness. Production begins this fall, and the show is expected to debut in spring 2014.

It is written by Noah Hawley ("The Unusuals," "My Generation") and executive-produced by Hawley, Joel and Ethan Coen, and Warren Littlefield. Berstein, who is represented by ICM Partners, will also executive produce the premiere. FX Productions and MGM Television produce.

The film "Fargo" was nominated for seven Academy Awards. The Coens won for Best Original Screenplay and Frances McDormand won for Best Actress. It was named as one of the 100 Greatest American Movies by the American Film Institute.

Patrick, Stenhouse make up following wreck

LONG POND, Pa. (AP) ? Danica Patrick left the bumpy ride with boyfriend Ricky Stenhouse Jr. on the track.

The relationship is still smooth sailing at home.

Patrick says there were some "silent moments" on the way home from Sunday's Coca-Cola 600 after Stenhouse drove his car into the side of his girlfriend's car and ended her race. It was the first run-in for the NASCAR rookies since they announced in February they were dating.

Patrick says it was impossible to stay quiet for too long since they shared a ride home. She says "we're fine."

Patrick participated Wednesday in the Stewart-Haas Racing testing session at Pocono Raceway.

Weightlessness of space used to design better materials for Earth

May 29, 2013 ? Researchers from Northeastern University are among the many scientists helping NASA use the weightlessness of space to design stronger materials here on Earth.

Structural alloys might not sound familiar, but they are an integral part of everyday materials, such as aircraft wings, car bodies, engine blocks, or gas pipelines. These materials are produced through solidification? -- a process similar to the making of ice cubes. "Solidification happens all around us, either naturally, as during the crystallization of familiar snow-flakes in the atmosphere, or in technological processes used to fabricate a host of materials, from the large silicon crystals used for solar panels to the making of almost any human-made object or structure that needs to withstand large forces, like a turbine blade," said Northeastern University Prof. Alain Karma, who was a collaborator in this study.

The transition of a structural alloy from liquid to solid is morphologically unstable, meaning that the interface between solid and liquid evolves from a planar morphology to a non-planar cellular structure during solidification -- essentially, the same instability is responsible for the branched star shape of snow flakes.

But what if you could take gravity out of the mix? Researchers say by observing the solidification process in a microgravity environment -- in this case, the International Space Station -- they were able to study how this morphological instability develops in three dimensions to shape the structure of materials on a micron scale. "Without gravity, there is no buoyancy force to mix the atomic constituents in the melt by fluid flow," said Prof. Karma. "As a result, solidification creates unique, more organized, structures that cannot be observed on earth. Understanding how those structures form in space gives insight for designing lighter and stronger materials that can be made on earth."

The Tumblr app is, admittedly, a wonderfully designed one. And there's no denying it has more functionality than something like Postcards. But for those who use Tumblr more as a means of finding articles to read instead zipping through streams of GIFs, this might be exactly what you're looking for.

What does it do?

Turns each post on Tumblr into individual "cards," which you can then swipe left and right to move backwards and forwards in your dashboard. As far as functionality, you can double-tap to like a post, hit reblog, or view all posts from a single user. And that's all there is to it.

Why do we like it?

Whether or not you'll be a fan of Postcards depends very much on how you use Tumblr as a whole. If you like to casually pass through pages of GIFs, pictures, and short little quips, this app probably doesn't make much sense. But flicking side-to-side is a fun, intuitive way to change up how you interact with your dashboard. And for someone who uses Tumblr to discover reading material, the lack of features brings along a welcome lack of distraction from your desired content. You can't create new posts, though. So if anything, Postcards is probably more of a nice enhancement to your Tumblr consumption?not a replacement.

Serial+ for iPhone review: Never lose track of warranty info or serial numbers again

If you own a lot of gadgets and software programs, and let's face it, most of us do, keeping tracking of warranty information and serial numbers can become overwhelming. Serial+ aims to solve that problem by bundling them all into one easy to use app complete with Dropbox sync, so no matter what happens, all your product information is safe.

Serial+ has one main purpose: to store all the information that matters about your electronics, gadgets, and software. This includes general information such as model numbers, serials, purchase amounts, and photos. These are excellent items to keep track of in case you ever need to file a warranty claim with an insurance company. Beyond that, you can also store manufacturer's warranty information as well as any extended warranty info you need. Warranties will default to one year but you can change them if you need to by just editing the information manually.

When it comes to storing software information, this is where you'll want to put all your product licenses and activation codes. Serial+ also gives you a spot to store version numbers and how many licenses a serial provides. You can plug anything else you need to know into the notes field. If a serial number is tied to an email account, you'll also have a place to save that email address as well. You can also choose to passcode lock the app so unauthorized individuals can't access your records.

As far as backing up your Serial+ data, you've got a backup option via Dropbox. Just link your Dropbox account and Serial+ will start creating backup files of your warranty and serial information. If you ever get a new iPhone or have to replace one, you can simply hop into settings and bring down all your information from your last Dropbox backup. If you need to share information with someone whether it's for a warranty claim, or you just want a hard copy to send to yourself periodically, you can export your information into a .csv or plain text file. These two formats should be sufficient for any insurance claim you may need to make.

If you own lots of electronics or software, it's essential to have a way to track all that information. Not only can Serial+ help if you ever get into a situation where an item is stolen and you needs its information for a claim, but can help expedite tech support calls. I've had numerous times where I need to call about a product and don't have the serial on hand. With Serial+, that problem is all but gone. I can just pop into the app and access serials and warranty info in a few simple taps.

House chairman subpoenas documents on Benghazi

(AP) ? A House chairman has issued subpoenas for State Department documents related to the widely debunked talking points about the cause of the deadly attack on U.S. diplomatic mission in Benghazi, Libya, last year.

Republican Rep. Darrell Issa (EYE'-suh), chairman of the House Oversight and Government Reform Committee, is seeking material from 10 current and former State Department officials. He sent a letter on Tuesday to Secretary of State John Kerry pressing for the documents by June 7.

Issa said the 100 pages of emails and other information released by the White House earlier this month did not answer questions about who at the State Department, other than former spokeswoman Victoria Nuland, expressed reservations about the talking points.

Four Americans, including Ambassador Chris Stevens, were killed in the attack.

Roger Clemens still dogged by NY steroids case

NEW YORK (AP) ? Despite Roger Clemens' victory last year in his perjury case, a defamation lawsuit filed against the former Yankees ace more than four years ago in federal court in Brooklyn is threatening to keep alive allegations that he used steroids and cheated on his wife.

A magistrate judge in the civil case last week ordered lawyers for Clemens to turn over government documents to the plaintiff, former strength coach Brian McNamee, including 22 FBI reports and notes from an Internal Revenue Service agent that refer to Clemens' alleged affairs. The lawyers had argued the material, some based on FBI interviews of various women, was made up of "inadmissible rumors."

Judge Cheryl Pollak wrote that adultery "is not usually found to be probative of a witness' character for truthfulness or untruthfulness." But, she added, lawyers for McNamee "might be able to cross-examine Mr. Clemens about instances in which he allegedly lied about his relationships, since in that case, the basis for impeachment would be dishonesty."

Given "the sensitive nature" of the FBI reports and IRS notes, Pollak said they would be filed under a protective order that would keep them private for now.

Lawyers representing Clemens in the civil case had sought to withhold more than 1,600 pages of documents from the government's criminal probe on the basis that they were grand jury material. However, the judge found that much of the material ? including bank statements, letters and business records ? should be turned over to the plaintiffs, saying that "documents produced in response to federal grand jury subpoenas does not automatically shield them from disclosure."

Pollak's order "gives us the essential fruits of the government investigation" in a civil case that doesn't require the higher standard of proof needed in the criminal one, Richard Emery, an attorney for McNamee said Sunday.

"All we have to prove is that Clemens more probably than not lied and that McNamee didn't," he said.

The 2009 federal lawsuit, which seeks unspecified damages, alleges Clemens launched an "intense and coordinated public relations offensive" against McNamee after the trainer told federal investigators and Congress that he injected Clemens more than a dozen times with steroids and human growth hormone from 1998 through 2001.

The suit quotes Clemens saying in a YouTube video in 2007 that McNamee "did not inject steroids into my body either when I played in Toronto for the Blue Jays or the New York Yankees." It also cites an interview with ESPN in May in which Clemens, when asked about McNamee, responded that it was a case of "somebody out there that is really crawling up your back to make a buck."

McNamee called Clemens a "pathological liar" in a story published Sunday in the Daily News.

"Steroid abuse was rampant in Major League Baseball and he was the father of it," McNamee said.

There was no response to messages left Sunday with an attorney for Clemens. Neither he nor McNamee are expected at a status conference set for Wednesday in Brooklyn.

Last year, a Washington jury found the seven-time Cy Young Award winner not guilty of lying to Congress about steroids and human growth hormone. He had adamantly denied using either substance at a 2008 congressional hearing.

The prosecution's case at a two-month trial had relied heavily on the testimony of McNamee, who told jurors he injected Clemens with steroids and HGH many times. The defense focused on how McNamee's story evolved over time, and there was no one else to claim firsthand knowledge of Clemens' drug use.

Former country music star Mindy McCready, who died this year, made headlines in April 2008 when she claimed a longtime relationship with Clemens. He has denied that claim.

'Should I stay or should I go?' Scientists link brain cell types to behavior

May 27, 2013 ? You are sitting on your couch flipping through TV channels trying to decide whether to stay put or get up for a snack. Such everyday decisions about whether to "stay" or to "go" are supported by a brain region called the anterior cingulate cortex (ACC), which is part of the prefrontal cortex. Neuroscientists from Cold Spring Harbor Laboratory (CSHL) have now identified key circuit elements that contribute to such decisions in the ACC.

CSHL Associate Professor Adam Kepecs and his team today publish results that, for the first time, link specific brain cell types to a particular behavior pattern in mice -- a "stay or go" pattern called foraging behavior. The paper, published online in Nature, shows that the firing of two distinct types of inhibitory neurons, known as somatostatin (SOM) and parvalbumin (PV) neurons, has a strong correlation with the start and end of a period of foraging behavior.

Linking specific neuronal types to well-defined behaviors has proved extremely difficult. "There's a big gap in our knowledge between our understanding of neuron types in terms of their physical location and their place in any given neural circuit, and what these neurons actually do during behavior," says Kepecs.

Part of the problem is the technical challenge of doing these studies in live, freely behaving mice. Key to solving that problem is a mouse model developed in the laboratory of CSHL Professor Z. Josh Huang. The mouse has a genetic modification that allows investigators to target a specific population of neurons with any protein of interest.

Kepecs' group, led by postdocs Duda Kvitsiani and Sachin Ranade, used this mouse to label specific neuron types in the ACC with a light-activated protein -- a technique known as optogenetic tagging. Whenever they shone light onto the brains of the mice they were recording from, only the tagged PV and SOM neurons responded promptly with a 'spike' in their activity, enabling the researchers to pick them out from the vast diversity of cellular responses seen at any given moment.

The team recorded neural activity in the ACC of these mice while they engaged in foraging behavior. They discovered that the PV and SOM inhibitory neurons responded around the time of the foraging decisions -- in other words whether to stay and drink or go and explore elsewhere. Specifically, when the mice entered an area where they could collect a water reward, SOM inhibitory neurons shut down and entered a period of low-level activity, thereby opening a 'gate' for information to flow in to ACC. When the mice decided to leave that area and look elsewhere, PV inhibitory neurons fired and abruptly reset cell activity.

"The brain is complex and continuously active, so it makes sense that these two types of inhibitory interneurons define the boundaries of a behavior such as foraging, opening and then closing the 'gate' within a particular neural circuit through changes in their activity," says Kepecs.

This is an important advance, addressing a problem in behavioral neuroscience that scientists call "the cortical response zoo." When researchers record neural activity in cortex during behavior, and they don't know which type of neurons they are recording from, a bewildering array of responses is seen. This greatly complicates the task of interpretation. Hence the significance of the Kepecs team's results, for the first time showing that specific cortical neuron types can be linked to specific aspects of behavior.

"We think about the brain and behavior in terms of levels; what the cell types are and the circuits or networks they form; which regions of the brain they are in; and what behavior is modulated by them," explains Kepecs. "By observing that the activity of specific cell types in the prefrontal cortex is correlated with a behavioral period, we have identified a link between these levels."
